SALARIES.

Employees must negotiate their salaries (rate and frequency of payment), work hours and meal arrangements (provided or self bought and prepared) with their employers. Sleeping, cooking and ablution facilities will be provided by the employer. Employees do not pay for housing. Employers must pay the minimum wage as per state legislation. (See list below) Wages will depend on hours worked. Our USA office will assist you with any problems you may have while working in the USA.

FAQ.

We only have jobs available in the agriculture sector: mostly on general grain farms, dairies, cattle ranches, jobs on feedlots, with silage contractors and with harvesters.  Code 14 truck drivers are also in high command.

We recruit all year round, but the jobs are seasonal and usually start around March-June, we also have contracts starting around August-October.

This is not a “working holiday” but a professional work opportunity, you are employed directly by a USA employer on a fixed contract basis for anything between 6-10 months at a time, there after you have to return to SA before you will be able to return to the USA.  If you want to return you will have to go through the whole process again, completing our forms, paying relevant fees and visiting the USA Consulate.

Waiting for a placement can take anything between 1 week up to a few months, depending what time of year we receive your application, the type of work you want to do (there are certain seasons for certain jobs) & your practical agriculture experience and your age.  Most employers usually start looking for employees only a month or so before they need workers.  The decision of who will work  where, lies entirely with the employers and is made according to their specific requirements and needs.  After receiving the application form,  the applicant is short listed and presented to the USA employers by our USA Office – PSG (Kellie Sutton situated in Gower, MO).

We work in close collaboration with Liza Viljoen at Travel Set, based in Gauteng, they have years of experience in getting employees to & from their destinations at the best possible fare.   Employees usually leave in groups. Depending on the employer returning employees may leave 1-3 weeks earlier than new employees.  Employers meet their employees at the airport.  Included in the fare is a compulsory insurance cover and medical insurance.

Once approved by an American employer, the applicant will be contacted for Consulate arrangements. We make all the arrangements including flight bookings.  You will have to visit the Consulate in person on the appointed date.  It is very important to realise, that no Consulate arrangements can be made if the petition from the INS in the USA has not been received, nobody can go to the Consulate without a petition. These petitions can arrive a month before the employer needs his workers but can sometimes also be late. There is nothing we, the employers or the American office can do about it.  Employers apply for these petitions months before they need employees, as it has to go through a Government Department in the USA for processing.

A worker may potentially stay in the US for 36 months, moving from one contract to another. After three years, the worker must return to SA and spend a minimum of three months in the country before applying for an H2A visa again.

The I-94 form is an “Arrival / Departure Record” issued to all non-immigrant US visitors.
Usually, all these visitors received this form upon their arrival, but the CBP (U.S. Customs and Border Protection) has changed it so that an electronic format is created automatically and not given physically to the visitor. However, an I-94 in paper format can be accessed by going to the CBP website and printing one.

We strongly recommend that all H2A workers get this form in paper format by following these steps:

Go to https://i94.cbp.dhs.gov/I94/#/home

Confirm that the following information is correct:

  • – Spelling of your name and surname
  • – All personal information
  • – The Visa category
  • – The expiry date of the authorized stay

If there are any errors, contact the CBP as soon as possible

If all is correct, print out the form (we recommend printing more than one copy of the form)

Then take your I-94 with you if you apply for your license or social security card.

H2A legislation in the US states that you must be paid per hour. You must at least be paid the minimum wage per hour of the state in which you work.

An employer must guarantee work and/or pay to the worker for at least three-quarters of the working hours offered in the contract.

If the Department of Labor determines that an employer has unfairly terminated the contract, the three-quarter rule will apply. The three-quarter rule also applies to a natural disaster (“act of God”) which may cause the worker to not complete the contract.

However, the three-quarter rule does not apply to workers who terminate their contract early or who have been fired for a legitimate reason.
